The Annual Meeting held originally on March 14th needed a quorum of 20% representation of the homes in "good standing" (no delinquencies) either in person or by proxy. At that time there were fewer than 18 homes represented in order to conduct business. A Recall Meeting was set for April 11.

The Recall for the March 14th Annual Meeting was held at 3pm Saturday, April 11th at Firewheel Town Center. Per bylaws, a first Recall Meeting to conduct business only requires 10% representation of the homes, or 9 homes. There were homeowners from 7 homes who attended, but proxies from 11 other homes allowed business to be conducted.

First order of business was to elect homeowners for two positions that expire at the time of this year's Annual Meeting. Positions expiring were for K. Bonelli (HR) and K. Wee (HR)'s seats filled in 2007. Positions for S. Macadory (AT), C. Shane (HR) and L. Sawyer (WW) will expire at the Annual Meeting in 2010.

During the past year, S. Macadory and K. Bonelli had resigned from the Board. S. Macadory's position and remaining term was filled by R. Dietlin by appointment of the Board. K. Bonelli's position went unfilled.

Two homeowners were on the ballot to fill the Board positions for 2009-2011. They were K. Martin (AT) and K. Wee (HR). By unanimous vote, both K. Martin and K. Wee were elected to fill the open Board Positions. Officers of the Board of Directors will be selected by the Board Members at the next scheduled Board meeting.

One Amendment to the DCCR's was on the ballot for the Annual Meeting. Amendment changes require 2/3rds representation of the homes, regardless of "good standing". There were not 59 or more homes represented at the meeting, so the Amendment did not come up for discussion or vote.

Ten homeowners attended the Annual Meeting Saturday at Firewheel Mall meeting room suite 250. There was not enough representation to hold quorum for a meeting to vote on Board members for two positions opening up for new two-year terms. DCCR bylaws call for another meeting to be held not less than 10 days nor more than 50 days from the original meeting date.

Please check this website for a new date to be announced. Postcards will be sent with the new announcement.

Those who attended the meeting stayed for a 2 hour information session.

An informal gathering will be held next Saturday, March 21 to do brush cleanup along the Autumn Trail side of the Common Area greenbelt. Those who would like to volunteer their time can come to the Mossy Glen cul-de-sac at 9:00am. In case of rain, the cleanup will be rescheduled.

Unwanted 'Briefing' newspaper from the Dallas Morning News

This is a resident update to address frequent complaints about the free newspaper circular from Dallas Morning News. This message was sent out to all owners on the email list. Please share the information with your neighbors since they may not have requested email updates from the HOA.

Many, many owners have called to request that the HOA do something to stop this nuisance.

Unfortunately, the neighborhood cannot address the issue as a whole. You may have seen the story on Channel 8 news a few weeks ago. The Dallas Morning News does not have any plans to discontinue the "service", but they have made a way for individual owners to request discontinuation.

Decrease the free circulation to help prevent the littered appearance of your neighborhood.

Let's keep Fall Creek safe

There was a police report filed last month on January 21 for "Criminal Mischief $50 L/T $500" occurring on Harvest Run at 01:00.

There are MANY police report incidents in the neighboring streets on Lavendale, Pueblo and Bosque.

To help minimize this in Fall Creek, this is a reminder to be good citizens and good neighbors and to be on the lookout for suspicious activity in our community. Please report suspicious activity (break-ins, theft, criminal mischief) to the police at 911. For non-emergencies (eg, code enforcement), call 972-485-4840.

Fall Trash Bash and Fun Day

Have you noticed things are looking a little better around the neighborhood?

Your Fall Creek Landscape and Beautification Committee has done all the legwork in making over the front entrance.

This past weekend, Fall Creek participated in the City of Garland's Fall Trash Bash city-wide event. Fall Creek homeowners turned out to pick up trash and trim trees along the Greenbelt starting at Ravine Crossing/Overlook and heading east.

We topped Saturday off with the Fall Fun Day in the Mossy Glen cul-de-sac with food, fun and prizes for parents and kids.

We'd like to thank the volunteers who set up the events and the neighbors who came in for a good cardio-vascular workout sweating off some pounds and spilling blood from some thorny patches.

In addition to three Home Depot gift cards from the HOA, we acknowledge donations from the following organizations and individuals:

  • T-shirts and trashbags from the City of Garland
  • Gloves and ropes from Rudy Castro of Consumers Choice Construction
  • Cases of water from Paul Smith
  • Two bottles of Fall Creek label wine from MaryKathryn Sherrard of Village Association Management
  • Mystery prize from Eva Wu. (What did your wife think of the prize, Lazerick?)

This is not the end. The beautification of Fall Creek will be continuing. Expect dramatic changes along Pleasant Valley in the next few months.

And we will continue cleanup along the Greenbelt this winter after the leaves have fallen. Expect another call of arms and muscles and sweat to join Committee members, Board members and neighbors who regularly volunteer their precious weekend time on these neighborhood events.

Vitality Grant - Phase I

Accolades to the Landscape Committee for their work in bringing to fruition Phase I of our Garland Neighborhood Vitality Grant funds -- the redesign of the Fall Creek entrance and addition of magnolia trees along Shalimar (click for larger pictures):

More flexibility in paying HOA Dues

Village Association Management now has Online Assessment payment available directly to the secure Lockbox at First Bank HOA. First Bank is the bank used by Fall Creek Addition HOA, Inc. You will need your coupon payment book with your HOA identification number, account number and zip code to complete the process.
The Online payment system will allow you to make one-time payments, or to set up recurring payments semi-annually or annually on the date that you specify.
If you prefer to continue mailing checks, the coupon book mailing address is to a Lockbox (bank deposit center) in California. However, the management company is still locally owned and operated. If you do not want to mail checks to California, you may continue to them to the Garland, TX P.O. Box address.
Please remit payment by September 20th to avoid penalties.

Increasing Fuel Costs Prompt City of Garland Environmental Waste Services Rate Increase

Due to significant escalations in fuel cost, mid-year rate increases are required for residential and commercial solid waste collection customers. The disposal gate rate charged to non-Garland residents and commercial customers using the City’s landfill and Transfer Station will also be increased. The new rates take effect August 1, 2008.
New rates will be as follows:
* The current monthly residential sanitation rate of $16.25 will increase by $1.84 a month for a total monthly rate of $18.09.
* Commercial solid waste collection rates will increase by 10% based on the size(s) and type(s) of container(s) and the collection frequency
* Landfill disposal gate rates will increase by $5.00 per ton (non-Garland residents and commercial customers).
* New rate for automatic dumping vehicles: $35.00 per ton
* New rate for trucks and trailers that do not automatically dump: $52.50
* Transfer Station disposal gate rates will increase by $5.00 per ton (non-Garland residents and commercial customers).
* New rate for automatic dumping vehicles: $52.50 per ton
New rate for vehicles that do not automatically dump: $78.75

16 persons from 13 homes attended Tuesday's make-up Annual Meeting with proxies from 29 other homes for a total representation of 42 homes. However, 4 of the 42 homes were not eligible for voting on amendment changes due to not having their HOA dues current.

The proposed amendments to the DCCRs were not brought up for a vote due to insufficient representation from enough eligible homes (defined as homes with HOA dues current).

There was enough representation (25%) for a vote on two seats for the HOA Board. Chris Shane's and Rich Dietlin's seats were up. A motion to re-nominate Chris Shane was accepted by Chris Shane and motion was seconded. A motion to re-nominate Rich Dietlin was declined by Rich Dietlin. A motion to nominate Larry Sawyer was accepted by Larry Sawyer and motion was seconded. Voting for approval of the two nominees was passed.

The Fall Creek Annual Meeting held on March 18 at Nicholson Memorial Library did not have enough people for quorum to hold a meeting.

The make-up Annual Meeting is being held today, again at the Nicholson Memorial Library at 7:00pm. The library is located at 625 Austin Street in downtown Garland.

8 homeowners and 7 proxies were in attendance at the Fall Creek Annual Meeting on March 18 at Nicholson Memorial Library, short of the 22 combined homeowners+proxies required for quorum to hold a meeting.

Without quorum and the ability to hold the Fall Creek Annual Meeting, the Annual Meeting will be postponed, tentatively set for Tuesday, April 22. The proxies will valid for 60 days beyond March 18th.

  • A meeting was held at 7pm on Feb 16th at 2218 AT to discuss the Amendments to the DCCRs that will be voted upon at the Annual Meeting on Tuesday, March 18th at 7pm at the Nicholson Memorial Library, 625 Austin Street in downtown Garland.

  • No changes to the proposed amendments were made, so the document will be voted upon as-is.

There will be a Town Hall Meeting on Saturday, February 16th at 7pm at the home of Stanley "Mac" Macadory, President of the Fall Creek HOA.

We will be discussing amendments to our DCCRs (Declaration of Covenants, Conditions and Restrictions) that will be voted on during the Annual Meeting on Tuesday, March 18th.
